How do I handle legal disputes related to short-term rental properties in Dubai?

Handling legal disputes related to short-term rental properties in Dubai involves a few essential steps. Dubai’s Rental Dispute Settlement Centre (RDC), under the Dubai Land Department (DLD), is the primary body for resolving conflicts between landlords and tenants, including short-term rentals. Here’s a step-by-step guide to navigating such disputes:

  1. Attempt Amicable Resolution

Before escalating any issue to a formal dispute, it is advisable to try and resolve matters directly with the tenant or landlord. Open communication can often solve issues such as maintenance, noise complaints, or unauthorized activities without legal intervention.

  2. Document Everything

Ensure you have all relevant documentation ready before filing a complaint. These may include:

    • Tenancy contract (Ejari certificate)

    • Copies of rent payments (e.g., cheques issued)

    • Communication records (emails or written notices)

    • Photographic evidence or any documents supporting your claim.

  3. File a Complaint with the RDC

If an amicable solution is not possible, you can file a formal complaint with the Rental Dispute Settlement Centre. The process involves:

    • Submitting the necessary documents, including tenancy contracts and communication records.

    • Paying a registration fee, which is 3.5% of the annual rent, with a minimum of AED 500 and a maximum of AED 20,000.

  4. Mediation and Hearings

The RDC will typically attempt mediation first. If mediation fails, the case will proceed to a hearing. Both parties can present their cases, and the RDC will issue a judgment. Legal representation is not mandatory but may be beneficial for complex cases.

  5. Appealing Decisions

If you are dissatisfied with the judgment, you have the option to appeal within 15 days. The appeal will be reviewed by a higher department within the RDC, and further escalation to the Court of Cassation is possible if the claim exceeds AED 330,000.

  6. Common Dispute Types

    Common issues include:

    • Unlawful rent increases

    • Disputes over security deposit deductions

    • Maintenance responsibilities

    • Unauthorized subletting or eviction disputes

By following these steps, you can ensure that any disputes related to your short-term rental in Dubai are handled efficiently and legally.
